Dear Ms. Catalan: In your letter dated October 23, 2002, you requested a tariff classification ruling. The submitted photographs depict various knee supports, ankle supports, and elbow supports. None of these items immobilizes the joint; they all allow for normal range of motion. The basic knee support and the patella cut-out knee support are tubular-shaped and are made of neoprene rubber laminated on both inner and outer surfaces with knit fabric. The ends are open. The “Patellar” knee supports and the simple hinged knee support are constructed of a tubular-shaped neoprene rubber laminated on both inner and outer surfaces with knit fabric. They are designed with opened ends and feature spiral stays with opposing loop and lock straps above and below the patella opening. The universal fit knee support is a wrap-around support made of neoprene rubber laminated on both inner and outer surfaces with knit fabric and features hook and loop closures and a lock strap. The “Kallassy” ankle supports are made of nylon fabric. One is designed with a lock strap and the other is a lace-up with a lock strap. The tennis elbow strap is designed as a wrap-around to be placed just below the elbow to provide extra support. It is constructed of textile fabric. The short profile tennis elbow support is designed to be placed just below the elbow to provide extra support. It is constructed of neoprene rubber laminated on both inner and outer surfaces with knit fabric. The applicable subheading for the above-described articles will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . other. The rate of duty will be 7 percent ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on the universal cock-up wrist support. Your request for a classification ruling should include an actual sample. When this is available, you may wish to consider resubmission of your request. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
