Dear Mr. Krost: In your letter dated October 10, 2002, you requested a tariff classification ruling. The merchandise to be imported consists of modular system shelving and racking. The shelving and racking will be in finished component form, which will be assembled for the customer. The units feature a boltless design that provides for easy assembly without nuts, bolts or shelf clips; all that is needed is a hammer or mallet. The shelving system is available in wood, steel or square wire mesh decking. The steel components have an iron phosphate pre-treatment followed by a baked epoxy powder coated finish. The applicable subheading for the modular system shelving and racking, if made of metal, will be 9403.20.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other metal furniture, Other: Counters, lockers, racks, display cases, shelves, partitions and similar fixtures.” The rate of duty will be free. The applicable subheading for the modular system shelving and racking, if made of wood, will be 9403.60.8080, HTS, which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
