Moran Co., Inc. 475 Douglas Pike Smithfield, RI 02917 RE: The tariff classification of costume jewelry in a box from China. Dear Mr. Suri: In your letter dated August 30, 2002, on behalf of F.A.F. Inc., you requested a tariff classification ruling. The submitted sample consists of two pairs of earrings and two necklaces made of metal and imitation gemstones. The jewelry items are attached to a cardboard display and packed in a hinged plastic rectangular-shaped dresser top utility/storage box measuring approximately 4 ½” x 5” x 2 ½”. The applicable subheading for the box will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for other household articles of plastics, other, other. The duty rate will be 3.4% ad valorem. The applicable subheading for the earrings and the necklaces will be 7117.19.9000, HTS, which provides for imitation jewelry: of base metal, whether or not plated with precious metal: other: other: other. The rate of duty will be 11% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
