Dear Ms. Kohmann: In your letter dated May 29, 2002, on behalf of Express, Inc., you requested a tariff classification ruling for a messenger bag. The sample submitted is identified as style 1234. The item is a messenger bag designed to transport items normally carried to and from the office or school. It is manufactured with an exterior surface of 100 percent cotton canvas fabric. The bag has a single textile lined interior compartment with a zippered pocket on the back wall and a pocket on the opposite wall, which is secured by means of hook and loop fasteners. The bag features an adjustable textile shoulder strap and it is secured by means of a flap with metal snap fasteners. The flap includes a zippered pocket on its exterior and the rear of the bag features a full-width open pocket. The bag measures approximately 14.75”(L) x 11.75”(W) x 5.25”(D). Your sample is being returned as requested. The applicable subheading for the messenger bag will be 4202.12.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, attache cases, briefcases, school satchels and similar containers, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty will be 6.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
