Dear Ms. Johnson: In your letter dated April 30, 2002, you requested a tariff classification ruling. The submitted photographs, Tattle,™ is a combination teether and rattle toy that is designed to both sooth an infant’s gums during teething as well as entertain him. The Tattle,™ measures approximately 2 inches in height and 5 inches in length and resembles a “knotty” handle connected to two ovals. The handle or center grip is made of ABS (Acrylonitrile Butadiene Styrene) and the oval rings are made of EVA (Ethylene Vinyl Acetate). Each oval ring is filled with distilled water and the handle contains tiny beads that produce a rattling sound. The product will be produced in blue and pink colors. The applicable subheading for the Tattle,™ will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
