NY I81396 May 8, 2002 CLA-2-61:RR:NC:TA:358 I81396 CATEGORY: Classification TARIFF NO.: 6110.30.3050; 6110.90.9090 Murray Holmes Speed Sourcing, Inc. 2140 City Gate Drive Columbus, OH 43219 RE: The tariff classification of knitted garments from Thailand, China, Hong Kong, and Cambodia Dear Mr. Holmes: In your letter dated May 3, 2002 you requested a classification ruling. Submitted style 1142 for men’s wear, characterized by long sleeves and by a full-front, zippered opening, which extends into the mock turtleneckline, is manufactured from 2 X 2 rib-knitted fabric of 55% acrylic/45% cotton, measuring ten stitches per two centimeters. Submitted style 75241 for girls’ wear, manufactured of 55% ramie/45% cotton, is a slightly scoop-necked pullover, through the mid-section of which a drawstring is threaded. The fabric of the lower portions of the long sleeves and of the body of the pullover is pointelle-knitted. The remainder of the fabric of the garment, which is 2 X 2 rib-knitted, measuring ten stitches per two centimeters, determines the essential character of the fabric of the pullover. As you have requested, the sample garments are being returned. The applicable subheading for style 1142 will be 6110.30.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters…and similar articles, knitted…, of man-made fibers, other, other, other, other, other, men’s; and for style 75241 will be 6110.90.9090, which provides for sweaters, pullovers…and similar articles, knitted…, of other textile materials, other, other, other, …girls’. The duty rates will be 32.4 and 6 per cent ad valorem, respectively. Style 1142 falls within textile category designation 638, and style 75241 within 838. Based upon international textile trade agreements products of Thailand, Hong Kong, China, or Cambodia are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
