NY I80933 May 22, 2002 CLA-2-17:RR:NC:SP:232 I80933 CATEGORY: Classification TARIFF NO.: 1702.90.5800 Mr. Rick Kyle Corn Products International, Inc. 6500 South Archer Avenue Bedford Park, IL 60501-1933 RE: The tariff classification of a syrup blend from Mexico Dear Mr. Kyle: In your letter dated April 23, 2002 you requested a tariff classification ruling. The subject merchandise is described as a 50/50 blend of 42% high fructose corn syrup and liquid sugar. The high fructose corn syrup will have 71% solids, and the liquid sugar will have 67.5% solids. The blended product will have a dry substance of 69.25%. The product will be imported in railroad tank cars. The blended syrup will be used as a beverage sweetener. The applicable subheading for the 50/50 blend of 42% high fructose corn syrup and liquid sugar be 1702.90.5800, Harmonized Tariff Schedule of the United States (HTS), which provides for Other sugars…sugar syrups not containing added flavoring or coloring matter…other…other: Blended syrups described in additional U.S. note 4 to chapter 17…other. The general rate of duty will be 33.9 cents per kilogram of total sugars plus 5.1 percent ad valorem. In addition, products classified in subheading 1702.90.5800, HTS, which are not goods of Canada, Mexico or Jordan, will be subject to additional duties based on their value, as described in subheadings 9904.17.66 to 9904.17.72, HTS. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
