Dear Ms. Smith: In your letter dated March 29th, 2002 you requested a tariff classification ruling. The first sample submitted is identified as Style number BA0266, “Getaway Lux”, a sports bag made of nylon with an external PUcoating, measuring approximately 25”W x 12”H x 9”D. It has a large zippered main compartment, an exterior zippered small-items pocket and various other open exterior pockets for additional small-items storage. The bag has one interior pocket with a hook and loop closure. It has two padded webbing adjustable straps and a textured bottom. Inside this bag there is a snap-in removable, zippered shoe bag made of nylon. The applicable subheading for the bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20% ad valorem. The second sample submitted is identified as Style number BA0265, “Day Plus Lux”, a tote bag made of nylon, measuring approximately 12”W x 14”H x 5”W, with an external PU coating. It has a large zippered main compartment, an exterior zippered small-items pocket and two open exterior pockets for additional small-items storage. There is an interior padded organizer/divider with a hook and loop closure and a zippered pocket. This bag has two padded webbing straps, convertible backpack straps for an added carrying option and a textured bottom. Inside this bag there is a small nylon handbag, measuring 5”W x 9”H with a Velcro closure and a long nylon strap. Style BA0265 consists of two components, the tote bag and the handbag. The articles are put up for retail sale to the user without repackaging and that the two serve the useful function of providing storage, protection, organization and portability for personal effects. The tote bag is classifiable in subheading 4202.92.4500, HTSUSA and the handbag is classifiable in subheading 4202.22.8050, HTSUSA. As such the article is a set according to General Rule of Interpretation 3(b). The traveling bag imparts the essential character. The applicable subheading for Style BA0265, “Day Plus Lux” will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20% ad valorem. The third sample submitted is identified as Style number BA0263, “Full Day Lux”, a handbag, measuring approximately 18”W x 10 ½”H, made of nylon with an external PU coating. It has a drawcord and magnetic snap closure, padded webbing adjustable straps and a textured bottom. There is an external side seam zippered small-items pocket and an interior attached organizer with a zippered pocket. Inside this bag there is a removable nylon mesh zippered coin purse. The handbag is classifiable in subheading 4202.22.1500, HTSUSA and the coin purse is classifiable in subheading 4202.32.9550, HTSUSA. The handbag imparts the essential character. The applicable subheading for Style BA0263, “Full Day Lux” will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of plastic. The rate of duty will be 16.8% ad valorem. The fourth sample submitted is identified as Style number BA0264, “Go Lux”, a tote bag made of nylon, measuring 12”W x 16”H, with an external PU coating. It has a drawstring closure, an exterior open pocket, and an interior zippered small-items pocket. There are webbed nylon shoulder straps at the sides. The applicable subheading for the bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20% ad valorem. The fifth sample submitted is identified as Style number BA0275, “Presto Sling Bag”, a shoulder bag made of molded EVA foam on the bottom and sides of the bag and padded nylon mesh for the body, measuring approximately 17”W x 12”H x 4”D. It has a large zippered main compartment and an exterior slash pocket. Inside there is a divided mesh pocket and a padded divider with a hook and loop closure. The shoulder strap is padded and adjustable. The applicable subheading for the bag will be 4202.12.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, attache cases, briefcases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The rate of duty will be 18.1% ad valorem. All samples will be returned as requested. . This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
