Dear Ms. Dorfman: In your letter dated March 6, 2002, on behalf of LTD Commodities Inc. you requested a tariff classification ruling. The submitted assortment, HLI-Hanging Holiday Decorations, consists of three designs of fabric decorations that hang from a door or a wall. Code HRT, Hearts, consists of two red, one pink and two red and pink cotton and polyester three dimensional hearts that measure approximately 3-7/8” in height and 4”across (from point-to-point) and hang from red ribbons mixed with raffia. The two red and pink hearts and the pink heart have the words “I Love You” and tiny printed red hearts in a repeating pattern. When hanging and fully extended, the decoration measures approximately 21-inches long. A catalog page accompanying the sample indicates that the item is sold as part of the Valentine's Day line of merchandise. The hearts are purely decorative. Code CLV, Clovers, consists of five cotton and polyester three dimensional clovers (three leaflet shamrocks) of various shades of green that measure approximately 4” in height and 4-1/2” across (from point-to-point) and hang from silver and gold ribbons mixed with raffia. When hanging and fully extended, the decoration measures approximately 21-inches long. A catalog page accompanying the sample indicates that the item is sold as part of the St. Patrick’s Day line of merchandise. Code EGG, Eggs, consists of five decorated cotton and polyester three dimensional eggs that measure approximately 4” in height and 2-1/4” in diameter and hang from yellow ribbons mixed with raffia. When hanging and fully extended, the decoration measures approximately 21-inches long. A catalog page accompanying the sample indicates that the item is sold as part of the Easter line of merchandise. The applicable subheading for the HLI-Hanging Holiday Decorations (Code HRT, Hearts, Code CLV, Clovers, and Code EGG, Eggs) will be 9505.90.6000, HTS, which provides for festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: other: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
