Van Arnam, Jr. Barnes, Richardson & Colburn 475 Park Avenue South New York, NY 10016 RE: The tariff classification of staining cloths from China. Dear Mr. Van Arnam: In your letter dated March 20, 2002, on behalf of Textus USA, Inc., you requested a tariff classification ruling. Two samples of a staining cloth were submitted. The staining cloths are made of a 100 percent woven cotton fabric panel. One measures approximately 19-3/8” x 13-1/2”. Two edges of this panel were folded inward and double stitched down the middle. The other two edges are finished with an overlock stitch. The other sample measures approximately 25-1/2” x 25” with one hemmed edge and a selvedge edge. The remaining two edges are finished with an overlock stitch. You stated that the articles are intended to be used as a staining cloth, appropriate for use on furniture, cabinets, hardwood floors and other woodwork surfaces. The applicable subheading for the staining cloths will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
