Kingshighway St. Louis, MO 63139 RE: The tariff classification of mittens from China Dear Ms. Taykowski: In your letter dated March 19, 2002, you requested a classification ruling. Three samples were provided for review. Style BFM 1746 is an insulated and lined mitten constructed of a woven polyester fabric. The mitten features a coated fabric palm patch which extends to the thumb, an inner padded knuckle reinforcement, a partially elasticized wrist, a coated fabric reinforcement at the backside fingertip area, and a hook and clasp. The mitten has a dedicated mitten liner made of a fleece fabric that is overlaid with woven fabric at the gauntlet cuff. The liner is secured to the outershell mitten with four metal snaps at the wrist. The liner also features a drawstring tightener at the gauntlet bottom. The cumulation of features on the mitten shows a design for use in the sport of skiing. The essential character of the mitten is imparted by the outershell woven polyester fabric. Styles BFG 1746 and MFG 1746 are insulated and lined mittens with a complete palmside from fingertips to wrist that is constructed of a 90% polyester 10% cotton knitted fabric with a PVC coating. The balance of the mitten is constructed of a woven polyester fabric. The mitten also features a partially elasticized wrist, a coated fabric reinforcement at the backside fingertip area, an inner padded knuckle reinforcement and a hook and glasp. The mittens have a dedicated glove liner made of a fleece fabric that is overlaid with woven fabric at the gauntlet cuff. The liner is secured to the outershell mitten with four metal snaps at the wrist. The liner also features a drawstring tightener at the gauntlet bottom. The cumulation of features on the mittens shows a design for use in the sport of skiing. The essential character of the mitten is imparted by the outershell palmside knitted coated fabric. The applicable subheading for Style BFM 1746 will be 6216.00.4600, Gloves, mittens and mitts: other: of man-made fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem The applicable subheading for Styles BFG 1746 and MFG 1746 will be 6116.10.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
