Dear Mr. Meyer: In your letter dated March 8, 2002 on behalf of DZ Trading Ltd., Los Angeles, you requested a classification ruling. As requested your samples are being returned to you. Your sample, style IT-22950, is a woman’s sweater constructed from 100% acrylic cable knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The sweater features a shawl collar with lace details, long sleeves finished with lace, a full front opening with six button closures, and a 1x1 ribbed knit placket and bottom. The garment extends from the shoulder to the calf area. Style IT-23650 is a woman’s sweater constructed from 72% nylon, 17% mohair, 11% acrylic knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The sweater features a notched lapel collar, long hemmed sleeves with three non-functional buttons, a full front opening with six button closures, and a hemmed bottom. Two decorative appliques are sewn on the left panel. The garment extends from the shoulder to the ankle area. Style IT-24350 is a woman’s sweater constructed from 85% acrylic, 15% wool knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The sweater features a turn down collar, long sleeves, and full front opening with no means of closure. The collar, placket, sleeves, and bottom are finished with a shaggy fur-like fabric. The garment extends from the shoulder to the thigh area. Style IT-19316 is a woman’s empire style sweater constructed from 85% acrylic, 15% wool knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The sweater features a notched lapel collar with decorative embroidery, long hemmed sleeves, a full front opening with one snap closure, a woven strip of ribbon laced through the upper back and chest, a woven fabric bow in the chest area, and a hemmed bottom. Style 41601 is a woman’s sweater constructed from 100% wool cable knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. It features a 2x2 ribbed knit turn down collar, long sleeves with turn up cuffs, a full front opening with seven button closures, two twelve inch side slits at the bottom, and a 2x2 ribbed knit bottom. The applicable subheading for styles IT-22950, IT-23650, IT-24350 and IT-19316 will be 6110.30.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted and crocheted: of man-made fibers: other: other: other: other: sweaters: women’s. The duty rate will be 32.4% as valorem. The applicable subheading for style 41601 will be 6110.11.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests), and similar articles, knitted or crocheted: of wool or fine animal hair: of wool: sweaters: women’s. The rate of duty will be 16.2%. Styles IT-22950, IT-23650, IT-24350 and IT-19316 fall within textile category designation 646. Style 41601 falls within textile category designation 446. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
