Listowel, Ontario Canada N4W 2M7 RE: The tariff classification of Balloon Weights from Canada Dear Mr. Raycraft: In your letter dated February 27, 2002 you requested a tariff classification ruling. The item, presently without an item number, is a balloon weight made by wrapping sand in colored foil. The instant sample is three and a half inches in diameter. The foil is blue on the outside and silver on the inside, tied with a silver tie. Once a balloon has been inflated, it is tied with string. The other end of the string is tied to the balloon weight, allowing the balloon to be used to decorate a table. Because there is soil (sand) in the product, it is suggested you inquire about United States Department of Agriculture importation requirements from: United States Department of Agriculture APHIS/PPQ 220 Broening Highway, Suite 140 Baltimore, MD 21224 (410) 631-0075 The applicable subheading for the balloon weights will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for Other Toys; …: Other: Other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
