NY H87538 February 5, 2002 CLA-2-1:RR:NC:1:110 H87538 CATEGORY: Classification TARIFF NO.: 8471.60.2000 Mr. Brian Cochran Logitech Inc. 6505 Kaiser Drive Fremont, CA 94555-3615 RE: The tariff classification of a PDA Flexible Keyboard from the United Kingdom. Dear Mr. Cochran: In your letter dated January 8, 2002, on behalf of Logitech you requested a tariff classification ruling. The merchandise under consideration is a Flexible Keyboard for a PDA (Personal Digital Assistant). This keyboard is designed for use with a number of manufacturers PDAs such as Palm Pilots, Handspring Visors, etc. Part number 967209-0403 will be used for the purpose of this ruling. Actual part numbers will vary accordingly to correspond to a particular model of PDA. The Flexible Keyboard is designed to double as a protective carrying case that folds around the PDA in a tri-fold fashion. This keyboard utilizes the standard keyboard configuration consisting of 68 keys with function keys used to navigate on the PDA display. There are 10 additional function keys located at the upper section of the keyboard layout designated for home, select, cut, copy, paste, find, date, address, to-do, memo and mail. A fold out docking station at the top center of the keyboard connects the keyboard to a PDA. In HQ 964880, effective March 9, 2002, Customs revoked NY F89667. Customs determined that the handheld computer in question was classified under heading 8471. This ruling stated that the handheld computer in question meets the requirements of Note 5(A) of chapter 84. HQ 964880 further stated that handheld computers of this type satisfied Note 5(A)(a)(2) in that they are freely programmed in accordance with the requirements of the user. The Logitech Flexible Keyboard is designed for use with the type of PDA classified under heading 8471 in HQ 964880. The applicable subheading for the Logitech Flexible Keyboard (part no. 967209-0403) will be 8471.60.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Automatic data processing machines and units thereof…Input or output units, whether or not containing storage units in the same housing: Other: Keyboards.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
