Atlanta, GA 3033-4024 RE: The tariff classification of two stones from China Dear Mr. Owensby: In your letter dated December 20, 2001, you requested a tariff classification ruling. Two representative samples were submitted and were sent to our Customs laboratory in Savannah for analysis. The first sample, which is identified as “Mahogany” – item #G129, is a square piece of gray stone that measures approximately 30 cm X 30 cm X 1cm in thickness. It has one polished surface and beveled edges measuring 0.0787 inch. Our Customs laboratory has determined that this stone is composed of non-agglomerated granite. The second sample, which is identified as “Desert Gold” – item #G121, is a square piece of tan stone that measures approximately 30 cm X 30 cm X 1 cm in thickness. It has one polished surface and beveled edges measuring 0.0787 inch. Our Customs laboratory has determined that this stone is composed of non-agglomerated granite. The applicable subheading for the two granite products will be 6802.93.00, Harmonized Tariff Schedule of the United States (HTS), which provides for worked monumental or building stone (except slate) and articles thereof…other: granite. The rate of duty will be 3.7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
