Dear Mrs. Fair: In your letter dated September 27, 2001, you requested a ruling on tariff classification. You submitted a sample of a gazebo, which you identify as “Item #996274 (MFG code #31245) – Natural Canopy w/Hunter Green Trim – 11” x 11”.” We note that the box states 11’ x 11’. You state the canopy to be made of knitted polyethylene and that the frame is of steel. There are plastic corner pieces and endcaps, and metal stakes. It is designed to offer shade only as it is not waterproof nor are there sides. Both a waterproof cover and sides are available as optional accessories. The applicable subheading for this product will be 6306.22.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for tarpaulins, awnings and sunblinds; tents; sails for boats, sailboards or landcraft; camping goods: tents: of synthetic fibers: other: other. The general rate of duty in 2001 will be 9.2 percent ad valorem. The general rate of duty in 2002 will be nine percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
