Box 895 507 Kresson Road Voorhees, NJ 08043 RE: The tariff classification of a decorative glass bottle from China Dear Ms. Grelle: In your letter received in this office on June 01, 2001, on behalf of your client, DollarLand, Inc., you requested a tariff classification ruling. A representative sample of the item was submitted with your ruling request. The submitted sample is described as decorative salt art. The item consists of a conical-shaped, clear glass bottle, measuring approximately seven inches in height and one and one-half inches in diameter at the base. The bottle is topped by a plastic seal and tied with a raffia bow. Within the bottle are a few layers of dyed salt (light blue and coral). You indicated in your letter that this product will be available in a variety of colors and sealed bottles. You further indicated that this product will be sealed and labeled “For Decorative Purposes Only”. You stated in your letter that the unit value of this item is approximately $0.35. The applicable subheading for the decorative glass bottle with dyed salt will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: other glassware: other: other: valued over $0.30 but not over $3.00 each. The rate of duty will be 30 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
