One Bowerman Drive Beaverton, OR 97005 RE: The tariff classification of travel bags from Indonesia, and the Philippines. Dear Ms. Miller: In your letter dated May 15th, 2001, you requested a ruling on tariff classification. The samples submitted with your request are identified as follows: Style #SA0006, “Brasilia Team Shoe Bag,” is a zippered travel bag made of an exterior surface of textile material of man-made fibers. The interior is unlined and consists of a single compartment designed to hold various personal items. Style #BA0054 “Scout,” is a handbag made of an exterior surface of textile material of man-made fibers. The interior is unlined and consists of a single, zippered compartment with no additional features. The front exterior, which is concealed by a flap with a tuck lock closure, has a zippered pocket, multiple pencil slots and a plastic clasp. There are two zippered pockets on the exterior of the front flap and a pocket for a cell phone is sewn to the side exterior. A shoulder strap is permanently attached to the bag. Style #BA0136, “Life Vest,” is a handbag made of an exterior surface of textile material of man-made fibers. The interior consists of a single, lined, zippered compartment with a padded pocket that is designed to hold a CD player. There is a zippered pocket on the front exterior with a lined hand-entry pocket to keep hands warm. The bag has a shoulder strap with an unlined pocket. Style #BA0143, “Ball Carry Backpack,” is a backpack made of an exterior surface of textile material of man-made fibers. The interior consists of a central, lined zippered compartment. The front exterior has a zippered compartment which contains a mesh bag that is designed to carry shoes, a helmet, or ball. There is a zippered pocket on the side exterior and a zippered pocket on the front exterior, which is designed to hold a CD player. A carry strap is permanently attached to the bag. Style #BA0163, “Ready to Roll,” is a zippered travel bag with a telescopic handle and wheels. The exterior surface is made of textile material of man-made fibers. The overall bag resembles a teardrop bag. Style #BA0044, “Mess Hall Bag,” is a travel bag made of an exterior surface of textile material of man-made fibers. The interior of the bag consists of a single, lined compartment that is secured by a front flap with hook and loop and tuck lock closures. The interior of the front flap has a zippered pocket and open pockets of various sizes. The applicable subheading for #SA0006, #BA0143, #BA0044, and #BA0163 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags…of man-made fibers, other. The general rate of duty will be 18.3 percent ad valorem. The applicable subheading for #BA0136 and #BA0054 will be 4202.22.8050, HTS, which provides for handbags, whether or not with shoulder strap…of man-made fibers. The general rate of duty will be 18.3 percent ad valorem. Your samples are being returned as requested. These products fall within textile category designation 670. Based upon international textile trade agreements items classifiable under HTS subheading 4202.22.8050 of Indonesia, and the Philippines are currently subject to quota and the requirement of a visa. Items of Indonesia and the Philippines classifiable under HTS subheading 4202.92.3031are subject to the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
