Dear Ms. Ortiz: In your letter dated April 11, 2001, you requested a tariff classification ruling. As requested, the sample will be returned to you. Your submitted sample, style JJ309, is a 60% polyester and 40% cotton fleece (napped on the inside) knit woman’s jacket. The garment features a hood, long sleeves with rib-knit cuffs, a full frontal opening with a zipper closure, two kangaroo pockets and a rib-knit bottom. You state that style JJ309A is identical to style JJ309, except it is a 60% cotton and 40% polyester fleece (napped on the inside) knit woman’s jacket. The applicable subheading for style JJ309 will be 6102.30.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of man-made fibers: other, women’s. The duty rate will be 28.7 percent ad valorem. The applicable subheading for style JJ309A will be 6102.20.010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: of cotton, women’s. The duty rate will be 16.2 percent ad valorem. Style JJ309 falls within textile category designation 635. Based upon international textile trade agreements products of Malaysia are subject to quota and the requirement of a visa. Style JJ309A falls within textile category designation 335. Based upon international textile trade agreements products of Malaysia are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
