Dear Ms. Scoggan: In your letter, dated April 5, 2001, you requested a classification ruling on behalf of your client, Hobby Lobby, Oklahoma City, OK. The merchandise, comprised of foliage picks of slip-on, snap-on construction, is described thus: Item CP57 consists of three plastic fir branches on a pick. The branches are dusted with glitter and artificial snow. The article measures 9 ½ inches in length and it is 80 percent plastic, 20 percent iron wire. The essential character is imparted by the plastic component. Item CP59 consists of four branches of holly leaves and berries on a pick. The item is made of silver colored plastic and it measures 7 inches in length. It is 80 percent plastic, 20 percent iron wire. The essential character is imparted by the plastic holly leaves and berries. Item CP61 consists of seven plastic branches on a pick. The branches are colored gold. The article measures 8 ½ inches in length and it is 90 percent plastic, 7 percent iron wire, and 3 percent color dye. The essential character is imparted by the plastic foliage. Item CP63 consists of three plastic fir branches on a pick. The branches are colored gold. The item measures 11 inches in length and it is 90 percent plastic, 7 percent iron wire, and 3 percent color dye. The essential character is imparted by the plastic leaves. Item CP65 consists of gold colored, plastic branches on a pick. The item measures 8 ½ inches in length and it is 90 percent plastic, 7 percent iron wire, and 3 percent color dye. The essential character is imparted by the plastic branches. The applicable subheading for artificial foliage (items CP61 and CP65) will be 6702.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial flowers, foliage and fruit and part thereof; articles made of artificial flowers, foliage or fruit, of plastics, other, including parts. The rate of duty will be 3.4 percent ad valorem. The applicable subheading for Christmas decorations (items CP57, CP59, and CP63) will be 9505.10.2500, HTS, which provides for festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof, articles for Christmas festivities and parts and accessories thereof, Christmas ornaments, other, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
