Dear Ms. Wierbicki: In your letter dated April 12, 2001, on behalf of Avon Products, Inc., you requested a classification ruling for a handbag. The sample submitted is identified as “Comfort Sling Bag with Cell Phone Case” -#PP220504. The item is a teardrop style handbag designed to be worn over the shoulder similar to a rucksack. The exterior surface is composed of a textile fabric consisting of 55 percent ramie and 45 percent cotton. The bag measures approximately10”(H) x 7”(W) at it widest point. The bag features a textile lined, single compartment interior, an exterior zippered wall pocket and an adjustable, permanently attached sling type shoulder strap of vinyl. It has a removable self-fabric cell phone case. The top of the bag is secured by means of a textile zippered closure. The bag also features an additional side zippered compartment providing for easy access to the interior when the bag is slung over one’s shoulder. You have stated that the above style will be imported and sold at retail together with the self-fabric cell phone holder. Pursuant to General Rule of Interpretation GRI-3 (b), the handbag and cell phone holder is considered to be a set. The handbag will impart the essential character of the set. The self-material cell phone holder is classified under HTS subheading 4202.92.9036 for entry purposes only. The applicable subheading for the PP220504, the handbag with cell phone holder as a set, will be 4202.22.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, other. The duty rate will be 5.9 percent ad valorem. HTS 4202.22.6000 falls within textile category designation 871. Based upon international textile trade agreements products of China are subject to the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Your sample is being returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
