Morgan PBB USA, Inc. 883-D Airport Park Road Glen Burnie, MD 21061 RE: The tariff classification of Unprocessed Bee Pollen from Canada. Dear Mr. Morgan: In your letter dated March 20, 2001, on behalf of Graycliff Ltd. Of Grimsby, Ontario, Canada, you requested a tariff classification ruling. You submitted descriptive literature with your request. The subject merchandise is “Infinity Essence Concentrate”, a powder which is described as being solely unprocessed bee pollen. It will be harvested and packaged in plastic bottles with no other ingredients added. This product is then intended for use in the manufacture of personal care products. The applicable tariff provision for the unprocessed bee pollen will be 1212.99.0000, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for Locust beans, seaweeds and other algae, sugar beet and sugar cane, fresh, chilled, frozen or dried, whether or not ground; fruit stones and kernels and other vegetable products (including unroasted chicory roots of the variety Cichorium intybus sativum) of a kind used primarily for human consumption, not elsewhere specified or included: Other: Other. The general rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177). A copy of the ruling, or the control number indicated above, should be provided with the entry documents filed at the time this merchandise is imported.
