Dear Mr. August: In your letter dated March 9, 2001, you requested a tariff classification ruling for your item number 8428, Halloween signs. This item comes in two different styles. Each is packaged separately. The item consists of a polyurethane sign formed and painted to look like an aged wood sign. Each sign has a wire hanger. One style says “Happy Halloween”; the other style says “Happy Haunting”. The applicable subheading for the Halloween signs will be 9505.90.6000, Harmonized tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles…, other, other. The duty rate is free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
