Dear Ms. Pitts: In your letter dated March 29, 2001, you requested a classification ruling for two woman’s nightgowns, two women’s pajama sets and one woman’s robe. As you have requested, these garments are being returned to you. The garments are all made from 100% cotton lightweight knit fabric. Style 132P2724 is a pajama set. The sleeveless top has two sets of ¼ inch shoulder straps; a u-shaped neckline in front and back; and a plain, hemmed bottom. The pajama pants have an elasticized and drawstring waistband and hemmed leg openings. Style 132T2722 is a pajama set. The sleeveless pullover top has a rounded neckline and a plain, hemmed bottom. The pajama shorts have an elasticized waistband and hemmed leg openings. Style 132C2725 is a nightgown. The sleeveless garment has two sets of ¼ inch shoulder straps; a u-shaped neckline in front and back; and a plain, hemmed bottom. Style 132S2721 is a nightgown. The garment has short sleeves; a rounded neckline; and a hemmed bottom with side slits extending upward approximately four inches on each side. Style 132R2726 is a wrap robe. The garment ¾ length sleeves; a full front opening with attached ties; belt loops; and a hemmed bottom. The garment also has a self-fabric belt. The robe and belt are considered a composite good under the General Rules of Interpretation (GRI 3(b)) and classified under the Harmonized Tariff Schedule of the United States number for the robe. The applicable subheading for the pajama sets and the nightgowns will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit… pajamas of cotton. The rate of duty will be 8.6 percent ad valorem. The applicable subheading for the robe will be 6108.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit… bathrobes…and similar articles of cotton. The rate of duty will be 8.6 percent ad valorem. The pajama sets and nightgowns fall within the textile category designation 351; the robe falls within the textile category designation 350. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
