A sample of the After Shave Balm sampler was submitted with your inquiry and is being retained by this office. The item is an alcohol free moisturizing skin care product. The sample size packet of the After Shave Balm is securely attached to a tri-fold promotional card. Based on your literature, the item will be used to solicit orders. The applicable subheading for the After Shave Balm will be 9811.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for any sample (except samples covered by heading 9811.00.20 or 9811.00.40), valued not over $1 each, or marked, torn, perforated or otherwise treated so that it is unsuitable for sale or for use otherwise than as a sample, to be used in the United States only for soliciting orders for products of foreign countries. The rate of duty will be free. Perfumery, cosmetic and toiletry products are subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
