Dear Ms. O'halloran: In your letter dated February 21st, 2001, on behalf of Fossil Partners, you requested a ruling on tariff classification. The samples submitted with your request consist of handbags and a school satchel. Item ZB9051250 is a school satchel made of an exterior surface of 100% cotton textile material. The interior is lined and is designed to hold books and papers. The front exterior, which is concealed by a front flap with a snap closure, has sewn-on pencil holders, open pockets, and a clear vinyl window for an I.D. card. Item ZB9050 Olive is a handbag made of an exterior surface of 100% cotton. The interior consists of two lined compartments that are separated by a full-width zippered pocket. The top opening is secured by a self-material tab with a snap closure. An adjustable shoulder strap is permanently attached to the bag and two pockets are sewn to the front exterior. Items ZB9041, ZB9042001, and SL3542 are handbags made of 100% polyester textile material. The interior of each is lined and secured by a zippered closure. ZB9042001 has an auxiliary compartment that is secured by both a zippered closure and front flap with hook and loop closure. Each bag has an adjustable shoulder strap and pockets on the front exterior. The applicable subheading for ZB9041, ZB9042001, and SL3542 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap…of man-made fibers. The general rate of duty will be 18.3 percent ad valorem. The applicable subheading for ZB9050 Olive will be 4202.22.4500, HTS, which provides for handbags, whether or not with shoulder strap…of cotton. The general rate of duty will be 6.6 percent ad valorem. The applicable subheading for ZB9051250 will be 4202.12.8020, HTS, which provides for attache cases, brief cases, school satchels…of cotton. The general rate of duty will be 18.3 percent ad valorem. Items classifiable under HTS subheadings 4202.22.4500 and 4202.12.8020 fall within textile category designation 369. Based upon international textile trade agreements products of China are currently subject to quota and the requirement of a visa. Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are currently subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Your samples are being returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
