Dear Ms. Reinert: In your letter dated February 8, 2001, you requested a ruling on tariff classification. You submitted a brochure with illustrations of folding traps of various sizes and shapes for trapping fish, lobster, shrimp, crabs, octopus, and eels. All are vinyl-covered tensile steel frames supporting nets of polyethylene mesh or netting. This ruling will only cover the following item numbers: FT-A, FT-B, FT-C, and FT-FA. The applicable subheading for these nets will be 5608.19.2090, Harmonized Tariff Schedule of the United States (HTS), which provides for knotted netting of twine, of man-made materials, other, other, other. The general rate of duty will be 6.5 percent ad valorem. Item numbers FT-D, FT-S, and FT-FN cannot be ruled on because it is not clear from the brochure how the mesh is made. When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please include samples of the mesh or more detailed information on the formation of the mesh, specifically, whether it is of knit or knotted or other construction; also submit another brochure. Also, please state if you would like a ruling on FT-E. Item numbers FT-A, FT-B, FT-C, and FT-FA fall within textile category designation 229. Based upon international textile trade agreements products of China are currently subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
