Dear Ms. Carmina: In your letter dated February 7, 2001, on behalf of your client New Star Toys & Gifts, you requested a tariff classification ruling. The submitted sample is identified as model number 8429. This item is composed of a small flower pot made of glass with a metal stand and a plastic rose. The leaves are also made of plastic. The center of the plastic rose features a miniature blinking light and musical capability underneath. A tiny red button in the top of the flower pot, when pressed, activates the musical chip and the blinking light. In our opinion, the plastic flower imparts the essential character to this article. The applicable subheading for the artificial flower will be 6702.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: of plastics: other, including parts. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
