D Valley Stream, NY 11581 RE: The tariff classification of a wooden pull toy from China Dear Ms. Diaz: In your letter dated February 9, 2001, received in this office on February 13, 2001, you requested a tariff classification ruling on behalf of Helen So. The submitted article is referred to as a “Mobile”, style number 8963. The item is a wooden pull toy that depicts an early model aircraft driven by a full figured pilot. The pilot is permanently fixed to the vehicle, which is suspended from an 8” coil spring. The product is designed to hang from the ceiling, shelf, etc. A wooden ball dangles from a cord underneath the aircraft. When the cord is pulled the product bounces in midair, causing the wings of the aircraft to flap up and down as if it were flying. The product is designed primarily for amusement purposes. Your sample is being returned as requested. The applicable subheading for the “Mobile” pull toy, style number 8963, will be 9503.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys; reduced-size (“scale”) models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
