NY G86990 February 14, 2001 CLA-2-62:RR:NC:TA:354 G86990 CATEGORY: Classification TARIFF NO.: 6212.30.0020 Ms. Shelly Post Limited Distribution Services 1114 Avenue of the Americas New York, New York 10036 RE: The tariff classification of a ladies’ corset from China Dear Ms. Post: In your letter dated February 5, 2001, you requested a classification ruling on behalf of Lane Bryant, a division of the Limited Inc. The provided sample will be returned as per your request. Style 565409 is a ladies’ corset composed of knitted 92% polyester 8% spandex fabric with lined underwire cups and a power mesh lining. The garment measures approximately15-¾ inches at the center and approximately 14 inches at the sides. The garment has nine panels and two flexible front stays measuring approximately 8 inch long and 6 flexible stays at the side and rear measuring approximately 13 inches long. A full rear opening allows for size adjustment when secured by lacing a ribbon through 19 double rows of metal eyes. Additionally, the garment features an elasticized band with a rubberized finish at the inner top hem which helps to secure the garment in place and a hemmed bottom. It is designed to shape the torso from below the bust to bottom of the stomach. The applicable subheading for style 565409 will be 6212.30.0020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: Corsets . . . of man-made. The duty rate will be 24 percent ad valorem. Style 565409 falls within textile category designation 649. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
