Mr. Ralph Garcia Customs Specialist 6400 Katella Avenue Cypress, California 90630-5208 RE: The tariff classification of motor vehicle Hose and Pipe Assemblies, Emission Vacuum from Japan Dear Mr. Garcia: In your letter dated January 30, 2001 you requested a tariff classification ruling. You submitted technical drawings of Hose and Pipe Assemblies, Emission Vacuum imported as replacement parts for Mitsubishi vehicles: Parts Numbers MR266922, MR355116, and MR367538. You state that these Assemblies consist of a rubber (Chlorosulfonated Polyethylene, M. Class) hose, not reinforced, of varying lengths and about 3/8 of an inch in diameter, attached to a seamless steel tube of about 1/4 of an inch in diameter and of varying lengths. The rubber hose is protected against contact with other engine components and vibration damage with a foam rubber material, which extends to about 80% of the length of the hose. The steel tube is bent to shape and it has an attached metal bracket for mounting onto the intake manifold or other locations within the engine compartment. The hose does not include fittings for mounting onto the tube. The tube simply fits into the hole of the hose. The Hose and Pipe Assy, Emission Vacuum is part of the vehicle emission control system. The purpose of these lines is to rout fuel vapors from the fuel tank to a charcoal canister and to the intake manifold for the burning of fuel vapors and preventing contaminant gases from being released into the atmosphere. The applicable subheading for the Hose and Pipe Assemblies, Emission Vacuum will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705. Other parts and accessories: Other: Other: Other: Other…Other. The rate of duty will be 2.5% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
