Two samples were submitted with your request: Style TSCD, 100% Cotton Interlock Knit Cardigan and Style TSPP2, 100% Cotton Interlock Knit Pant. You state that Style TSCD and Style TSPP2 will be imported packaged together in a polybag, and sold as a babywear set under Style TSPCA. Style TSCD is a 100% Cotton Interlock Knit Cardigan. The long-sleeve pastel cardigan features a full front opening with four snap closure; rib knit piping; and a heat transfer logo on the upper left chest area. The logo is a symbol of Pooh Bear surrounded by leaves. Style TSPP2 is a 100% Cotton Interlock Knit Pant. This garment features long legs; a full elastic waist; and rib knit piping at the leg openings. The overall print pattern of leaves and bees on the pant coordinate with the heat transfer logo of a Pooh Bear on the cardigan. The Infant “Sincerely Pooh” Babywear Set will be imported in Infant Sizes XS and SM. Both garments will be returned to you as requested. The applicable subheading for the Babywear Set will be 6111.20.6020, Harmonized Tariff Schedule of the United States (HTS), which provides for Babies’ garments and clothing accessories, knitted or crocheted: Of cotton: Other: Other: Sets. The rate of duty is 8.2%. The Infant “Sincerely Pooh” Babywear 100% Cotton Knit Cardigan and Pant Set falls within Textile Category Designation 239. Children’s sleepwear, sizes 0-14, are subject to the standards and requirements of the Flammable Fabrics Act which is regulated by the Consumer Products Safety Commission (Code of Federal Regulations, Subchapter D, Part 1615, 1616). Failure to meet these requirements will require Customs to prohibit entry into the commerce of the United States. The CPSC has published a notice involving a stay of enforcement of the sleepwear requirements against skin tight or nearly skintight garments currently being used as sleepwear. Please contact the CPSC to determine the status of this merchandise for compliance purposes. This ruling applies to the classification of the merchandise and not to its admissibility under the terms of the Consumer Products Safety Commission standards. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
