Crew Group, Inc. 770 Broadway New York, NY 10003 RE: The tariff classification of two women’s knit upper body garments to be manufactured in Hong Kong Dear Ms. Chan: In your letter dated November 2, 2000, you requested a tariff classification ruling. The submitted samples, designated style numbers 42458 and 42472, are women’s upper body garments manufactured from a 100% cotton rib knit fabric having ten or more stitches per centimeter in both the horizontal and vertical directions. Style number 42458 features a full frontal opening secured by eight small plastic buttons, long sleeves with rib knit cuffs, and a straight, selvaged bottom. Style number 42472 is sleeveless and features a straight neckline in front and back, rib knit shoulder straps measuring one inch in width, and a straight, selvaged bottom. The applicable subheading for style number 42458 is 6106.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s blouses and shirts, knitted or crocheted, of cotton. The applicable rate of duty is 20.2% ad valorem. The applicable HTS subheading for style number 42472 is 6109.10.0060, which provides for other women’s tank tops, knitted or crocheted, of cotton. The applicable rate of duty is 18.3%, ad valorem. The garments fall within textile category designation 339. Based on international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. The samples are being returned to you, as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
