Dear Ms. Castellanos: In your letter dated November 1, 2000, on behalf of Magnet, LLC, you requested a tariff classification ruling. Two samples were provided with your letter. Item 01980 Fix Max II is a sheet of white polyvinyl chloride (vinyl) with adhesive on one surface. The adhesive surface is protected by a peel-off paper liner. The sheet measures approximately 9 ½ inches in width. After importation the vinyl side will be imprinted with advertising and the sheet will be cut into various shapes. The printed articles can then be mounted to a surface by means of the adhesive. Item 01950 Fix Max II is described as double sided adhesive in sheets. It consists of adhesive in the form of a sheet with a protective paper liner on both sides. After importation the adhesive will be cut to various shapes and affixed to various items to act as a solid adhesive. Your samples are being returned as requested. The applicable subheading for the adhesive backed vinyl sheet, item 01980 Fix Max II, will be 3919.90.5060, Harmonized Tariff Schedule of the United States (HTS), which provides for self-adhesive plates, sheets, film, foil, tape, strip and other flat shapes, of plastics…other, other. The rate of duty will be 5.8 percent ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on the adhesive in sheet form. Your request for a classification ruling should include a complete breakdown of each ingredient in the adhesive, including each additive to the polymer. If the adhesive is sold at retail, indicate whether or not the retail quantities will weigh more than one kilogram. When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please resubmit the appropriate samples, as well as a copy of this letter. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
