Suite 1278 New York, NY 10017 RE: The tariff classification of a tote bag from China. Dear Ms. Kwok: In your letter dated October 27, 2000, you requested a tariff classification ruling for a tote bag. The sample submitted is identified as item (C-56337)-BBW#42554. The item is a double handle, open top tote bag designed to contain accessories and other small personal effects during travel. It is manufactured of clear polyvinyl chloride (PVC) sheeting with a floral textile trim. The interior is unlined with no additional features. The bag measures approximately 9”(W) x 6 ½”(H) with a 4” base. At the top center of the bag is a tie string to secure the center together. The applicable subheading for the tote bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem. There are no antidumping or countervailing duties on tote bags from China at this time. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
