Box 4800 Carrier Parkway Syracuse, NY 13221 RE: The tariff classification of seamless refined copper tubes from column 1 countries. Dear Mr. Steere: In your letter dated September 25, 2000, you requested a tariff classification ruling. You have described the subject merchandise as seamless refined copper tubes, ASTM B-280, both in coils and straight lengths. They are to be used in air conditioning and refrigeration units. The coils will typically be in 50-foot/15m lengths, from 1/8” to 1 5/8” in outside diameter, packaged individually in boxes. They will not be on spools. The straight length tubes will typically be in 20-foot lengths and be from 1/8” to 4 1/8” in outside diameter. The applicable subheading for the seamless copper tubes in coils (not on spools) and in straight lengths will be 7411.10.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for copper tubes and pipes: of refined copper: seamless: other. The general duty rate will be 1.5% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
