A/P Import Office 1617 Sixth Ave., Suite 1000 Seattle, Washington 98101-1742 RE: The tariff classification of three women’s sweaters from Hong Kong Dear Mr. Imbrogulio: In your letter dated August 21, 2000 and additional information submitted on September 14, 2000, you requested a tariff classification ruling. The samples which you submitted are returned as requested. You submitted three styles of women’s knit sweaters. You state in your letter that style 14301 is constructed from 85% acrylic, 10% nylon, 5% metallic and that styles 14302 and 14303 are constructed from 85% acrylic, 10% polyester, 5% metallic, knit fabric. The outer surface of the sweaters measures 9 or fewer stitches per 2 centimeters in the horizontal direction. Style 14301 features a crew neckline, long sleeves with ribbed cuffs, a full front opening with 3 button closures, and a ribbed bottom. Style 14302 is a sleeveless sweater that features a scoop neckline and a ribbed bottom. The neckline and the armholes are finished with ribbed fabric. Style 14303 is a sleeveless sweater that features a mock ribbed collar, an open circle below the collar and a ribbed bottom. The report that you submitted from an independent lab and the additional information that you submitted on September 14, 2000 ( we concur), states that each of the three styles are composed of two 2-ply yarns. The yarns of style 14301 consist of acrylic, nylon and metallic. The metallic yard consists of 81.2% polyester, 18.8% metallic. Styles 14302 and 14303 consist of acrylic, polyester and metallic. The metallic yard consists of 93.2% polyester, 6.7% metallic. You state in your letter that the metallic yard of each style is not gimped, twisted or cabled with the acrylic yard. This office finds the overall fiber content to be 85% acrylic, 15% metallic. The applicable subheading for the three styles will be 6110.30.3020 Harmonized Tariff Schedule of the United States (HTS), which provides for women’s sweaters, knitted: of manmade fibers: other. The duty rate will be 32.9%ad valorem. The three sweaters fall within textile category designation 646. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
