Evan Grunfeld, Desiderio, Lebowitz & Silverman LLP 245 Park Avenue, 33rd Floor New York, N.Y. 10167-3397 RE: The tariff classification of a woman's jacket and a woman's blouse from Hong Kong Dear Mr. Evan: In your letter dated August 17, 2000, on behalf of your client, Mast Industries, Inc., you requested a classification ruling. Two samples were submitted as follows: Style number 8629, is a woman's hip-length jacket that is constructed of a shell composed of a woven 72% rayon/22% nylon/6% spandex fabric. The jacket has a stand-up collar that is secured on the front portion of the neck by a tab with a snap closure, a full front opening that is secured by a zipper closure and a small overlapping flap that covers the zipper area. The jacket also has long sleeves with banded cuffs, two front sewn-in pockets located at the waist and a straight cut banded bottom hem that is secured on the front portion of the waistband by a snap closure. Style number 8610, is a woman's blouse that is constructed of a shell composed of a woven 72% rayon/22% nylon/6% spandex fabric. The blouse has a shirt-type pointed collar, a full front opening that is secured by a right-over-left five button closure, long sleeves with a one-button closure on the cuffs and a straight cut banded bottom hem. Each button features the "Venezia Jeans Clothing Co." logo. The samples are being returned to you as you have requested. The applicable subheading for style number 8629 will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTS), which provides for other women's anoraks, windbreakers and similar articles: of man-made fibers other. The duty rate will be 28.4 percent ad valorem. The applicable subheading for style number 8610 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for other women's blouses, shirts and shirt blouses: of man-made fibers. The duty rate will be 27.6 percent ad valorem. Style number 8629 falls within textile category designation 635. Style number 8610 falls within textile category designation 641. Based upon international textile trade agreements products of Hong Kong are presently subject to quota restraints and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
