International 112 W. 34TH Street Suite 1207 New York, NY 10120 RE: The tariff classification of a girl’s pullover and jumper from China Dear Ms. Hamui: In your letter dated July 14, 2000 you requested a tariff classification ruling. The submitted samples are a girl’s pullover made of 100% cotton knit fabric and a jumper made of 100% cotton woven denim fabric. The pullover features an elasticized scoop neckline with a bow, long hemmed flared sleeves with embroidery above the hems, a hemmed bottom, and a fabric loop on each side near the bottom hem for securing the pullover to the jumper. The jumper features a high rise bib front and back, shoulder straps sewn to the back bib that attach to the front bib with adjustable metal fasteners, an embroidered pocket on both the front and back bibs in contrasting denim, side openings with a two-button metal closure, a gathered skirt, two front pockets, and a sewn-on hem in contrasting denim accentuated with a decorative ribbon. The pullovers and jumpers will be imported in girls’ sizes 4 to 16. The samples will be returned to you as requested. The applicable subheading for the girl’s pullover will be 6110.20.2075 Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other…other: other: women’s or girls’. The rate of duty will be 18.2 percent ad valorem. The applicable subheading for the girl’s jumper will be 6211.42.0060 Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear: other garments: other garments, women’s or girls’: of cotton…jumpers. The rate of duty will be 8.3 percent ad valorem. The pullover falls within textile category designation 339 and the jumper falls within textile category designation 359. Based upon international textile trade agreements, products from China are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
