Chivini Austin Chemical Company, Inc. 1565 Barclay Boulevard Buffalo Grove, IL 60089 RE: The tariff classification of Naproxen (CAS-22204-53-1), imported in bulk form, from India Dear Mr. Chivini: In your letter dated April 7, 2000, you requested a tariff classification ruling. The subject product, Naproxen, is a nonsteroidal anti-inflammatory drug with analgesic and antipyretic properties. It is indicated for the management of acute painful conditions such as rheumatoid arthritis, osteoarthritis, juvenile arthritis, ankylosing spondylitis, tendonitis and bursitis, and acute gout. The applicable subheading for Naproxen, imported in bulk form, will be 2918.90.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for "[C]arboxylic acids with additional oxygen function and their anhydrides, halides, peroxides and peroxyacids; their halogenated, sulfonated, nitrated or nitrosated derivatives: Other: Aromatic: Other: Drugs." Pursuant to General Note 13, HTS, the rate of duty will be free. This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
