Customs Compliance Department 1617 Sixth Ave, Suite 1000 Seattle, WA 98101-1742 RE: The tariff classifications of beach cover ups from Turkey Dear Mr. Imbrogulio: In your letter dated February 4, 2000 you requested a tariff classification ruling. Style ON1083 is made from a woven terry fabric that you state is 100% cotton. This garment has a full front left over right opening secured by four plastic buttons, long sleeves, a hood, patch pockets on each front at the waist and side seam slits. All edges are hemmed. You indicated that this garment will be imported in sizes 2T to 4T. You have also stated that the identical garment will be imported in 6-month to 24-month sizes as style BN1083. Style G1049 is made from a woven terry velour fabric that you state is 100% cotton. This garment has a full front opening secured by a zipper, long sleeves, a hood, a kangaroo style patch pocket at the front bottom and side seam slits. All edges are hemmed. You indicate that this garment will be imported in girls’ sizes 4/5 to 14/16. In accordance with Chapter 62 Note 8, the applicable subheading for Style ON1083 will be 6207.91.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for Men’s or boys’ singlets and other undershirts, underpants, briefs, nightshirts, pajamas, bathrobes, dressing gowns and similar articles: Other: Of cotton: Bathrobes, dressing gowns and similar articles. The rate of duty will be 8.8 percent ad valorem. The applicable subheading for Style G1049 will be 6208.91.1020, HTS, which provides for Women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: Other: Of cotton: Bathrobes, dressing gowns and similar articles: Girls’. The rate of duty will be 7.9 percent ad valorem. The applicable subheading for Style BN1083 will be 6209.20.5050, HTS, which provides for Babies’ garments and clothing accessories: Of cotton: Other: Other: Other: Other. The rate of duty will be 9.5 percent ad valorem. Styles ON1083 and G1049 fall within textile category designation 350 and Style BN1083 within category 239. Based upon international textile trade agreements, products of Turkey in category 350 are subject to quota and the requirement of a visa. Style BN1083 in category 239 is not subject to quota nor does it require a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. Although you originally requested the return of both of your samples, in a subsequent series of telephone conversations, you agreed that Style ON1083 could be retained by Customs as a part of the reference collection of the National Import Specialist. In accordance with your request, Style G1049 will be returned to you under separate cover. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
