Dear Ms. Basford: In your letter, dated December 17, 1999, you requested a classification ruling. The merchandise is dog food that will be packaged for retail sale. It will be packed in 125 gram, re-sealable pouches and there will be 10 pouches per box/case. The products are not bulk products and they will not be sold in bulk containers. The items are described thus: 1. “Good Boy Chicken Burgers” (item 2163) – The ingredients are chicken meal, maize flour, soy flour, chicken fat, corn syrup, propane 1-2 diol, phosphoric acid, iron oxide, flavoring, titanium dioxide, potassium sorbate, and sodium propionate. 2. “Good Boy Salmon Steaks” (item 2183) – The ingredients are chicken meal, maize flour, soy flour, fish meal, chicken fat, corn syrup, gelatin, propane 1-2 diol, phosphoric acid, coloring, flavoring, titanium dioxide, potassium sorbate, and sodium propionate. 3. “Good Boy Sausage Rolls” (item 2173) – The ingredients are chicken meal, maize flour, soy flour, chicken fat, corn syrup, propane 1-2 diol, phosphoric acid, coloring, titanium dioxide, potassium sorbate, and sodium propionate. The applicable subheading for “Good Boy Chicken Burgers” (item 2163), “Good Boy Salmon Steaks” (item 2183), and “Good Boy Sausage Rolls” (item 2173), will be 2309.10.0010, HTS, which provides for preparations of a kind used in animal feeding, dog or cat food, put up for retail sale, in airtight containers. The rate of duty will be free. Additional requirements may be imposed on these products by the Food and Drug Administration.
