Box 5445 Carson, CA 90749 RE: The tariff classification of kitchen towels from India Dear Mr. Alden: In your letter dated November 24, 1999 you requested a classification ruling. You submitted eight yarn dyed kitchen towels. All of the towels are made from 100 percent cotton woven fabrics. They are hemmed on all four sides and measure approximately 20 x 30 inches. Style "Bouquet" is a green and white jacquard woven towel with a floral design and a hang loop in one corner. Style "St. Jean" is a plain-woven blue, yellow, green and white plaid towel. Style "La Crosse" is a gray twill towel with a pattern of squares formed by narrow white stripes in the warp and weft. Style "Lawton" is a white and indigo towel woven in a diamond pattern. Style "Santa Rosa" is a cream colored towel with narrow white dashed stripes in the warp and weft. Style "Ascot" is a white towel with narrow blue stripes in the warp. The towel features numerous small squares formed by warp and weft floats. Styles "Lawton", "Santa Rosa" and "Ascot" appear to have been made with a dobby weave. Style "Arrowhead" is a white towel made up of multiple weaves, including basket, herringbone and honeycomb. Style "San Clemente" is a yellow towel made with a honeycomb effect. The applicable subheading for the Style "Bouquet" kitchen towel will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton… other: towels: jacquard figured. The duty rate will be 9.8 percent ad valorem. The duty rate for the year 2000 will be 9.7 percent ad valorem. The applicable subheading for all of the other styles will be 6302.91.0045, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton… other: towels: other: dish. The duty rate will be 9.8 percent ad valorem. The duty rate for the year 2000 will be 9.7 percent ad valorem. Style "Bouquet" falls within textile category designation 363. The other styles fall within textile category designation 369. Based upon international textile trade agreements products of India are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
