One Trans-Border Drive P.O. Box 800 Champlain, NY 12919 RE: The tariff classification of travel utility pouches from Hong Kong. Dear Mr. Ralston: In your letter dated September 10th, 1999, on behalf of Buffalo-Eastcantra Inc., you requested a classification ruling for travel utility pouches from Hong Kong. The samples submitted with your request are travel utility pouches. Style numbers LT10 U-521-CS#407, LT11 U-521-70D, and LT12 U-521-420D measure approximately 8 1/8" in height by x 4 3/4" in length and are manufactured of a sheeting of Polyvinyl Chloride (PVC). On the rear of the cases there is a permanently attached belt loop. The user is able to access the interior of the pouches by pulling on a self-pull handle attached to zipper pulls on each side of the exterior and lifting a front flap with a hook and loop closure. The interior of the pouches are unlined and consist of a single compartment with no additional features. Style LT13 U-521-420D is identical to style numbers LT10 U-521-CS#407, LT11 U-521-70D and LT12 U-521-420D, except it is constructed of a textile material of man-made fibers. Style LT17 U-7584-70D measures approximately 8 1/2" in width by 5 1/4" in length and is manufactured of a sheeting of Polyvinyl Chloride (PVC). The interior of the pouch is unlined and consists of a single compartment with no additional features. The pouch is secured by a zip-around closure. The applicable subheading for the LT10 U-521-CS#407, LT11 U-521-70D, LT12 U-521-420D and LT17 U-7584-70D will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, other. The duty rate will be 20% ad valorem. The applicable subheading for the LT13 U-521-420D will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with an outer surface of textile materials, other, other, of man-made fibers, other. The duty rate will be 18.8% ad valorem. Items classifiable under HTS subheading 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). Your samples are being returned as requested.
