Dear Ms. Luna-Ogg: In your letter dated July 27, 1999, on behalf of Horizon Designs, Inc., you requested a tariff classification ruling. The sample is being returned as requested. The sample submitted is a binder. The outer shell is made of neoprene rubber covered on both sides with knit fabric. The inside is lined with a cardboard sheet covered with woven fabric. A web fabric binding material is sewn around the edges of the liner. The liner is glued to the outer shell. In its open position, the left side contains a zippered open work knit pocket. At the top is a plastic snap hook. The right side contains a vertical open pocket with an open horizontal pocket. The middle features three metal rings attached to a metal base. It is secured by means of a zipper closure on three sides. The applicable subheading for the binder will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
