Box 79086 Pittsburgh, PA 15216 RE: The tariff classification of an infant’s creeper, pants set, short set, T-shirt and dress from India. Dear Mr. Saluja: In your letter dated June 24, 1999, you requested a tariff classification ruling. The submitted samples are described as follows: Style #Z160 – An infant’s T-shirt. The garment is constructed of 100% cotton jersey knit fabric and features a scoop rib knit neckline, short sleeves and a hemmed bottom. Style #Z97 – An infant’s creeper. The garment is constructed of 100% cotton inter-lock knit fabric and features a scoop rib knit neckline, lap shoulders, short sleeves, and a snap crotch. Style #Z86 – An infant’s pants set. The garments are constructed of 100% cotton inter-lock knit fabric. The top features a scoop rib knit neckline, long sleeves, and a hemmed bottom. The pants feature an elasticized waist, and hemmed leg openings. Style #Z115 – An infant’s short set. The garments are constructed of 100% cotton inter-lock knit fabric. The top features a scoop neckline with a one button opening at the neck, short sleeves, and a hemmed bottom. The shorts feature an elasticized waist, and hemmed rib knit leg openings. Style #Z138 – An infant’s dress. The garment is constructed of 100% cotton inter-lock knit fabric and features a scoop neckline, a two button front closure, and short sleeves. The dress also has a drawstring waist, and a two layer self-fabric skirt below the waist. The outer skirt is open at the front. Your letter did not indicate the size(s) that the garments will be imported. For the purposes of classification, we assume that the garments will be imported for infants in sizes 0-24 months. The applicable subheading for the Short Set and Pants Set, Style #’s Z115 and Z86, will be 6111.20.6020 Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies, garments and clothing accessories, knitted or crocheted, of cotton, other, other, sets. The duty rate will be 8.4% ad valorem. The Short Set and Pants Set falls within textile category designation 239. Based upon textile trade agreements, products of India are presently not subject to quota restraints or visa requirements. The applicable subheading for the Creeper, Style #Z97, will be 6111.20.6010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, other, other, sunsuits, washsuits and similar articles. The duty rate will be 8.4% ad valorem. The Creeper falls within textile category designation 239. Based upon textile trade agreements, products of India are presently not subject to quota restraints or visa requirements. The applicable subheading for the Dress, Style #138, will be 6111.20.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, dresses. The duty rate will be 11.8% ad valorem. The Dress falls within textile category designation 239. Based upon textile trade agreements, products of India are presently not subject to quota restraints or visa requirements. The applicable subheading for the T-shirt, Style #160, will be 6111.20.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, T-shirts, singlets and similar garments, except those imported as parts of sets. The duty rate will be 18% ad valorem. The T-shirt falls within textile category designation 239. Based upon textile trade agreements, products of India are presently not subject to quota restraints or visa requirements. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
