PD E83455 July 2, 1999 CLA-2-61-NO:TC: I06 CATEGORY: Classification TARIFF NO.: 6102.10.0000, 6110.10.2080 Mr. John Imbrogulio Nordstrom 1617 Sixth Avenue Suite 1000 Seattle, Washington 98101 RE: The tariff classification of a knit cardigan and a knit coat from Hong Kong Dear Mr. Imbrogulio: In your letter dated June 15, 1999, you requested a tariff classification ruling. Two samples, Styles #s 3BW48426 and 3BW48425, were submitted. Both styles are composed, per your letter, of 100% wool finely knit fabric, Style # 3BW48426 is a womens coat featuring a full frontal opening with a two hook and loop closure; pointed collar; notched lapel; long sleeves; side seam pockets at the hip; and calf length. Style # 3BW49425 is a womens cardigan featuring a full frontal opening with a three button closure; pointed collar; notched lapel; two patch pockets below the waist; and long sleeves with cuffs. Per your request, your samples are returned herewith. The applicable subheading for the coat will be 6102.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for womenor girls overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6204: of wool or fine animal hair. The rate of duty will be 62.1 cents per kilogram and 18.2 percent ad valorem. The applicable subheading for the cardigan will be 6110.10.2080, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: other: other: womenor girls. The rate of duty will be 16.5 percent ad valorem. The coat falls within textile category designation 435. The cardigan falls within textile category designation 438. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
