Dear Ms. Knipper: In your letter of March 16, 1999, you requested a tariff classification ruling on behalf of Magaschoni Apparel Group. Samples of styles A724383, A724402, and A72707 were submitted for classification. Each style is composed of 100% silk fabric with a 71% rayon / 29% polyester wrap around fabric. Style A724383 extends from the waist to the area of the ankles. The garment has a side zipper and a 3/4 wrap around. The applicable subheading for the garment is 6204.69.4010, Harmonized Tariff Schedule of the United States which provides for womensilk trousers. The rate of duty is 4.3%. The garment falls into textile category 748. Style A724402is a womens skirt. It features the man made fiber fabric sewn on the inside part of the silk fabric and a side zipper. The applicable subheading for the garment is 6204.59.4040, Harmonized Tariff Schedule of the United States which provides for womens silk skirts. The rate of duty is 6.9%. The garment falls into textile category 742. Style A72707 is a womensleeveless dress with a round neck and a zipper under the arm hole. The applicable subheading for the garment is 6204.49.1000, Harmonized Tariff Schedule of the United States which provides for women?s silk dresses. The rate of duty is 7.2%. The garment falls into textile category 736. As products of Hong Kong, this merchandise is not presently subject to visa requirements based on international trade agreements and not subject to quota reporting. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
