Dear Ms. Pierce: In your letter dated March 5, 1999, you requested a tariff classification ruling. Based on the technical literature submitted, Resimene CE 4514 is a methylated, butylated melamine-formaldehyde resin solution composed of approximately 94 percent resin solids, 6 percent n-butanol and 0.5 percent formaldehyde, by weight. Resimene CE 6517 is a methylated, butylated melamine-formaldehyde resin solution composed of approximately 85 percent methylated, butylated melamine formaldehyde resin, 15 percent n-butanol and 1 percent formaldehyde, by weight. The applicable subheading for the Resimene CE 4514 and Resimene CE 6517 will be 3909.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Amino-resins, phenolic resins and polyurethanes, in primary form: Melamine resins. The rate of duty will be 6.5 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which is administered by the U.S. Environmental Protection Agency.
