Box 90099 Long Beach, CA 90809-0099 RE: The tariff classification of cordage and braid from China Dear Ms. Castellanos: In your letter dated March 2, 1999, you requested a classification ruling on behalf ;of Homecrest, Inc. Samples of products which the importer calls “lace” were submitted. The “lace” is actually either flat woven narrow fabric or braided cordage. According to your letter, all of the merchandise is made of a 55/45 linen/cotton blend. The sample card which contains representative samples of the braid and fabric indicated the merchandise to be made of a 55/45 ramie/ cotton blend. For purposes of this letter, we will assume the blend to be linen/cotton. The braids are all made in 144 yard lengths and put up on spools. They are all compactly braided. The construction differs only in the number of strand used to construct the braid. They measure in width from 3/32 to 5/16 inches. They are identified as style numbers 51381R32B, 51384R64B and 5138380B. The laces are made of flat woven fabric measuring from 3/16 to 1/4 inch in width with fast edges. The fabric is woven in 800 yard lengths and put up on spools. They are identified as style numbers 51553RC-13 and 51545RC-17. The applicable subheading for the braided cordage will be 5607.90.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for twine, cordage, ropes and cables, whether or not plaited or braided, other, other. The duty rate will be 6.8 percent ad valorem. The applicable subheading for the woven fabric will be 5806.39.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for narrow woven fabrics, other woven fabrics, of other textile materials, of vegetable fibers, except cotton. The duty rate will be 5.2 percent ad valorem. The braided cordage falls within textile category designation 201. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The narrow woven fabric falls within textile category designation 899. Based upon international textile trade agreements products of China require a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
